MORNING MESSAGE TERMS OF USE AND END USER LICENSE AGREEMENT

Effective Date: June 11, 2026

These Terms of Use and End User License Agreement (“Terms” or “Agreement”) are a legal agreement between you and H3 Innovations (“H3 Innovations,” “we,” “our,” or “us”) governing your access to and use of the Morning Message mobile application, related content, features, subscriptions, websites, and services, collectively referred to as the “App” or “Morning Message.” These Terms include the End User License Agreement for the App.

By downloading, accessing, creating an account, purchasing a subscription, or using Morning Message, you agree to these Terms. If you do not agree to these Terms, do not use the App.

About Morning Message

Morning Message is a faith-based encouragement, reflection, prayer, affirmation, reminder, and daily message app. The App may allow users to receive daily messages, create and manage personal entries, use preset or custom reminders, track completion history, archive items for reflection, and use writing assistance or other features intended to support personal encouragement and reflection.

Morning Message is intended for personal, inspirational, devotional, reflective, and organizational use only.

License to Use the App

Subject to your compliance with these Terms, H3 Innovations grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, access, and use Morning Message on devices that you own or control, solely for your personal, non-commercial use and as permitted by the applicable app store rules.

Morning Message is licensed, not sold, to you. H3 Innovations reserves all rights in and to the App that are not expressly granted in these Terms.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, attempt to derive the source code of, or create derivative works from the App, except to the extent such restrictions are prohibited by applicable law.

Eligibility and Age Requirements

Morning Message is not intended for children under 13 years of age. If you are under 13, you may not create an account or use the App.

If you are at least 13 but under the age of 18, you may use Morning Message only with the permission and supervision of a parent or legal guardian.

By using Morning Message, you represent that you are legally permitted to use the App and to agree to these Terms, or that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Accounts

You must create an account to use Morning Message. You agree to provide accurate information when creating or using your account and to keep your login credentials secure.

You are responsible for all activity that occurs under your account. If you believe your account has been accessed without authorization, you should contact us promptly at [email protected].

You may not use Morning Message in a way that violates applicable law, infringes the rights of others, interferes with the operation of the App, attempts to gain unauthorized access to systems or data, or misuses the App or its content.

Subscriptions, Purchases, Free Trials, and Billing

Morning Message may offer paid subscription features, free trials, introductory offers, limited access, or other subscription benefits described in the App at the time of purchase.

Subscription options, including the subscription title, duration, price, renewal terms, free trial or introductory offer terms, and included features, will be presented in the App’s purchase flow before purchase.

If you purchase a subscription through the Apple App Store, Google Play, or another app store, your purchase, billing, renewal, cancellation, and refund rights are handled by that app store and are subject to that app store’s payment terms and policies.

Subscriptions automatically renew unless canceled according to the applicable app store’s cancellation procedures. If a free trial or introductory offer is provided, your subscription will automatically convert to a paid subscription at the end of the trial or introductory period unless you cancel before the trial or introductory period ends.

Deleting the App or deleting your Morning Message account will not cancel your subscription.

You are responsible for managing or canceling your subscription through the applicable app store account settings. Refund requests must be made through the applicable app store unless otherwise required by law.

Faith-Based, Inspirational, and Reflective Content

Morning Message provides faith-based, inspirational, reflective, devotional, and organizational content. The App is designed to support reflection, encouragement, prayer, affirmation, reminders, and personal growth.

Morning Message is not affiliated with, sponsored by, endorsed by, or controlled by any church, denomination, ministry, religious organization, Bible publisher, Bible website, or religious content provider unless expressly stated.

Morning Message does not guarantee, predict, promise, or cause any particular spiritual, emotional, personal, relational, medical, financial, legal, or life outcome. The App does not guarantee that any message, prayer, affirmation, reminder, reflection, or other content will produce a specific result.

Morning Message does not provide medical advice, mental health treatment, counseling, crisis support, legal advice, financial advice, pastoral care, or professional services. If you are experiencing an emergency, crisis, risk of self-harm, risk of harm to others, or other urgent situation, do not rely on Morning Message. Contact emergency services, a qualified professional, a trusted person, or other appropriate local resources.

AI-Generated, Assisted, or Personalized Content

Morning Message may use automated tools, artificial intelligence, or other technology to help generate, suggest, summarize, organize, select, personalize, or deliver messages, writing assistance, reminders, reflections, or other App features.

This may include processing User Content in order to provide App functionality, personalize your experience, or support features you choose to use.

AI-generated or assisted content may be incomplete, inaccurate, inappropriate, repetitive, or not suitable for your particular circumstances. You are responsible for reviewing and deciding whether to use, edit, save, rely on, or share any generated, suggested, or personalized content.

You may not use Morning Message, including any AI-assisted or writing-assistance features, to create, request, store, generate, rewrite, or distribute unlawful, harmful, abusive, exploitative, deceptive, infringing, or dangerous content, including instructions or assistance for illegal activity.

H3 Innovations does not guarantee the accuracy, completeness, spiritual appropriateness, theological correctness, emotional suitability, or usefulness of AI-generated, assisted, or personalized content.

User Content

You may create, submit, save, store, edit, complete, archive, or delete content in Morning Message, including personal entries, reminders, completion history, archived items, and other content you create or manage in the App (“User Content”).

You retain ownership of your User Content. By using the App, you grant H3 Innovations a limited license to host, store, process, transmit, display, and use your User Content solely as needed to operate, maintain, secure, and provide the App and its features to you.

You are responsible for your User Content and for ensuring that your User Content does not violate the law, infringe another person’s rights, or include content you do not have the right to submit.

You should not submit or store highly sensitive information in Morning Message, including passwords, usernames for other services, financial account numbers, payment card numbers, Social Security numbers, government identification numbers, full addresses, health or medical information, protected health information if applicable, or other information you do not want processed or stored by the App.

Privacy

Your use of Morning Message is also governed by our Privacy Policy, which explains how we collect, use, store, and protect information. The Privacy Policy is available at:

Data Security and Unauthorized Access

H3 Innovations uses reasonable administrative, technical, and organizational safeguards designed to protect information submitted through Morning Message. However, no mobile application, website, internet transmission, server, database, cloud service, network, device, or electronic storage system can be guaranteed to be completely secure.

You understand and agree that you use Morning Message at your own discretion and that H3 Innovations cannot guarantee that your account, User Content, personal information, or other data will never be accessed, disclosed, altered, lost, stolen, corrupted, misused, or compromised.

To the fullest extent permitted by law, H3 Innovations is not responsible for unauthorized access, disclosure, loss, theft, corruption, or misuse of information caused by circumstances outside our reasonable control, including cyberattacks, security vulnerabilities, device compromise, user credential compromise, third-party service failures, app store or platform issues, hosting provider issues, internet or network failures, or unauthorized activity by third parties.

If we become aware of a security incident involving personal information, we will take reasonable steps to investigate, respond, reduce potential harm, and provide notice where required by applicable law.

Account Deletion

You may permanently delete your Morning Message account from within the App by going to Account, scrolling to the bottom of the screen, selecting Delete Account, and following the on-screen confirmation instructions.

When you complete the account deletion process, your Morning Message account and User Content associated with your account are permanently deleted from Morning Message’s active app database.

Deleting your Morning Message account will not cancel any active subscription purchased through the Apple App Store, Google Play, or another app store. You must cancel your subscription separately through the applicable app store account settings.

Deleting the App from your device will not delete your Morning Message account and will not cancel your subscription.

If you are unable to access the App and need help requesting account deletion, you may contact us at [email protected]. For security, we may need to verify that you are authorized to request deletion of the account. For your security, do not send sensitive information by email.

Certain records outside Morning Message’s active app database may not be deleted by the in-app account deletion process, including records maintained by app stores, payment processors, subscription providers, email providers, hosting providers, analytics providers, or other third-party services, where applicable. Those records are handled according to the terms and privacy policies of the applicable third-party service.

Third-Party Services, Links, and Scripture Content

Morning Message may include or link to third-party websites, Bible resources, BibleGateway, app stores, subscription management pages, payment processors, analytics providers, or other external services.

Third-party services are not controlled by H3 Innovations. We are not responsible for the content, accuracy, availability, security, privacy practices, or terms of any third-party services.

Your use of third-party services is at your own risk and may be subject to separate terms and privacy policies.

Morning Message includes or displays scripture references, Bible passages, religious content, devotional themes, and other materials. Some of this content may be provided by or derived from third-party sources and may be subject to copyright, licensing restrictions, attribution requirements, or separate terms from the applicable rights holder or provider.

The App displays scripture from the NET Bible®. Quotations designated “NET” are from the NET Bible® copyright ©1996, 2019 by Biblical Studies Press, L.L.C. All rights reserved. H3 Innovations does not claim ownership of third-party scripture translations, external Bible resources, or other third-party materials.

Notifications and Reminders

Morning Message may allow you to create reminders, receive notifications, or schedule messages. Notifications and reminders are provided for convenience only.

H3 Innovations does not guarantee that notifications, reminders, daily messages, or scheduled features will be delivered at a specific time or without interruption. Delivery may depend on your device settings, operating system, internet connection, notification permissions, time zone settings, app version, and third-party services.

You are responsible for any action you take or do not take based on reminders, notifications, or messages from the App.

App Availability and Changes

We may update, modify, suspend, discontinue, or remove features, content, or functionality of Morning Message at any time. We may also release updates, bug fixes, or changes that are required to continue using the App.

We do not guarantee that the App will always be available, uninterrupted, secure, error-free, or compatible with every device, operating system, or app store requirement.

Acceptable Use

You agree that you will not use Morning Message to:

1. Violate any law or regulation;
2. Infringe or misappropriate the rights of others;
3. Upload, store, generate, request, rewrite, or distribute content that is unlawful, abusive, threatening, defamatory, harassing, hateful, exploitative, deceptive, infringing, dangerous, or otherwise harmful;
4. Attempt to interfere with, disrupt, or compromise the App or its systems;
5. Attempt to access accounts, data, systems, or networks without authorization;
6. Use the App for commercial exploitation without our written permission;
7. Copy, scrape, harvest, or misuse App content or user data;
8. Use the App, including any AI-assisted or writing-assistance features, to generate, rewrite, request, or distribute harmful, misleading, or unlawful content, including instructions or assistance for illegal activity.

We may suspend or terminate access to the App if we believe you have violated these Terms or used the App in a harmful, unlawful, or abusive manner.

Intellectual Property

Morning Message, including its design, text, graphics, features, functionality, logos, name, software, code, and other content, is owned by H3 Innovations or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not use the Morning Message name, logo, branding, content, or materials without prior written permission from H3 Innovations, except as allowed by law.

Disclaimer of Warranties

To the fullest extent permitted by law, Morning Message is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.

H3 Innovations disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, security, and uninterrupted operation.

H3 Innovations does not warrant that the App will meet your expectations, produce any particular result, improve any circumstance, prevent any harm, or be free from errors, interruptions, vulnerabilities, or harmful components.

Limitation of Liability

To the fullest extent permitted by law, H3 Innovations and its owners, officers, employees, contractors, service providers, affiliates, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of data, loss of profits, loss of goodwill, emotional distress, personal decisions, spiritual outcomes, missed reminders, subscription issues, or other damages arising out of or related to your use of or inability to use Morning Message.

To the fullest extent permitted by law, H3 Innovations’ total liability for any claim arising out of or related to the App or these Terms will not exceed the greater of: (a) the amount you paid to H3 Innovations for use of the App during the twelve months before the claim arose, or (b) fifty U.S. dollars.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless H3 Innovations and its owners, officers, employees, contractors, affiliates, service providers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your User Content, your misuse of the App, your violation of these Terms, your violation of law, or your violation of another person’s rights.

Termination

You may stop using Morning Message at any time. You may also delete your account using the account deletion feature in the App, if applicable.

We may suspend or terminate your access to the App if you violate these Terms, misuse the App, create risk or potential legal exposure for H3 Innovations, or if we discontinue the App or any portion of it.

Upon termination, your right to use the App will end. Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

Apple-Specific Terms

If you download Morning Message from the Apple App Store, the following additional terms apply:

1. These Terms are between you and H3 Innovations, not Apple. H3 Innovations, not Apple, is solely responsible for Morning Message and its content.
2. Your license to use Morning Message is limited to a non-transferable license to use the App on Apple-branded products that you own or control, and as permitted by the Apple Media Services Terms and Conditions, including applicable usage rules, Family Sharing, and volume purchasing rules where applicable.
3. Apple has no obligation to provide maintenance or support services for Morning Message.
4. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, in accordance with Apple’s policies. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.
5. H3 Innovations, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar laws.
6. If any third party claims that the App or your possession or use of the App infringes that third party’s intellectual property rights, H3 Innovations, not Apple, will be responsible for the investigation, defense, settlement, and discharge of such intellectual property infringement claim to the extent required by these Terms and applicable law.
7. You represent and warrant that you are not located in a country that is subject to a U.S. government embargo or designated by the U.S. government as a terrorist-supporting country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
8. You agree to comply with all applicable third-party terms when using Morning Message, including applicable app store terms, device terms, mobile carrier terms, payment provider terms, Bible content provider terms, BibleGateway terms, and any third-party service terms that apply to services connected to or used by the App.
9. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as third-party beneficiaries.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the App, by email, or by other reasonable means. The updated Terms will be effective when posted or otherwise made available, unless a later effective date is stated.

Your continued use of Morning Message after updated Terms become effective means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law rules, unless applicable law requires otherwise.

Subject to applicable law, any legal action or proceeding arising out of or related to these Terms or Morning Message will be brought in the state or federal courts located in Pennsylvania, and you consent to the jurisdiction and venue of those courts.
